These Terms and Conditions ("Terms") form a binding agreement between you ("User", "you") and Khula Information Systems cc., a close corporation registered in the Republic of South Africa ("AutoMedic", "we", "us"), operator of automedic.co.za and the AutoMedic application (the "Platform") and all associated services (the "Services").
By accessing or using the Platform you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
If you register on behalf of a business or another person, you warrant that you are authorised to accept these Terms on their behalf.
AutoMedic is an online marketplace that connects vehicle owners ("Customers") with independent service providers ("Providers") offering:
Customers post service requests. Providers within range may ask questions and submit quotes. The Customer chooses a quote. AutoMedic then provides tools — messaging, job cards, work logs and ratings — to help both parties manage the work.
You must be at least 18 years old to use the Platform. By using it you warrant that you are 18 or older and have legal capacity to contract.
Providers additionally warrant that they are lawfully entitled to conduct their business in South Africa, hold any licences, registrations, permits and insurance their activities require, and are tax compliant.
Providers register themselves and supply their own business information, photographs and descriptions.
AutoMedic does not:
You are solely responsible for choosing a Provider. Before allowing work to proceed, you are strongly encouraged to confirm the Provider's identity, experience, insurance and references, agree the scope and price in writing, and — for significant work — obtain more than one quote.
AutoMedic does not process payments and does not hold funds in escrow. Payment is made directly by the Customer to the Provider by whatever means they agree.
AutoMedic is not responsible for non-payment, underpayment, overcharging, refunds, deposits, invoices, receipts or any financial dispute between the parties. Providers are responsible for issuing invoices and for their own tax obligations.
The Platform is currently free to both Customers and Providers. We may introduce fees, commissions or paid features in future; any such change will be notified in advance and will apply only from the date it takes effect.
To protect Customers, your street address and telephone number are withheld from Providers while a request is open, and are released only to the Provider whose quote you accept.

Misuse of Customer details is a material breach of these Terms and will result in removal from the Platform, in addition to any legal consequences.
Engaging a Provider often involves admitting a stranger to your home or handing over your vehicle. You accept that you do so at your own risk, and you are encouraged to:
AutoMedic accepts no liability for the conduct of any user, whether on or off the Platform.
All warranties or guarantees on workmanship and parts are given by the Provider, not by AutoMedic. Providers remain responsible for compliance with the Consumer Protection Act 68 of 2008 where it applies to them.
If a dispute arises, the parties must first attempt to resolve it directly. AutoMedic may, at its discretion and without obligation, supply relevant records — request details, quotes, messages, job-card entries and photographs — to assist. We do not adjudicate disputes, and we are not liable for their outcome.
Where the Platform allows you to submit reviews, ratings, photographs, messages, job notes or other material ("User Content"), you agree that:
You grant AutoMedic a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt and display your User Content for the purpose of operating and promoting the Platform. You retain ownership of your content.
We may remove, decline to publish, or moderate any User Content at our discretion, without notice. We do not routinely pre-screen content, and we are not responsible for opinions expressed by users.

We process personal information in accordance with POPIA. Full details of what we collect, why, who we share it with, how long we keep it and your rights are set out in our Privacy Policy, which forms part of these Terms.
We aim to keep the Platform available but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the Platform for maintenance, upgrades or business reasons, without liability.
The Platform and Services are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, secure or free of harmful components, that information on it is accurate, complete or current, or that any particular result will be achieved.
To the maximum extent permitted by South African law, Khula Information Systems cc., its members, directors, employees, agents and contractors are not liable for any direct, indirect, incidental, special, consequential or punitive loss or damage arising from:
Nothing in these Terms limits any liability that cannot lawfully be excluded, including under the Consumer Protection Act.
You indemnify and hold harmless Khula Information Systems cc., its members, directors, officers, employees and agents against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees on an attorney and own client scale) arising from your use of the Platform, your breach of these Terms or any law, your infringement of third-party rights, your User Content, or any dispute between you and another user. This clause survives termination.
All content on the Platform — text, graphics, logos, icons, software and data compilations — belongs to Khula Information Systems cc. or its licensors and is protected by South African and international law. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You may not reproduce, distribute, republish, sell, modify or exploit any part of it without our written consent.
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if we are required to do so by law, if we reasonably suspect fraudulent, unsafe or abusive conduct, or if your account is dormant for an extended period. You may stop using the Platform and delete your account at any time. Clauses that by their nature survive termination — including 11, 12, 17, 18, 19 and 22 — continue to apply.
We may amend these Terms at any time. The current version is always on the Platform with an updated "Last updated" date. Material changes will be notified by email or a prominent in-app notice. Continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Platform.
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Arbitration Foundation of Southern Africa ("AFSA") under its expedited rules, before one arbitrator appointed under those rules. Nothing prevents either party from seeking urgent interim relief from a competent court, or from approaching the Consumer Goods and Services Ombud, the National Consumer Commission or the Information Regulator where applicable.
You consent to receiving communications from us electronically, and agree that electronic communications satisfy any legal requirement that a communication be in writing, in terms of the Electronic Communications and Transactions Act 25 of 2002.
If any provision is found unlawful or unenforceable, it will be severed and the remaining Terms continue in force. We may assign our rights and obligations without notice; you may not without our written consent. Our failure to enforce any provision is not a waiver of it.
These Terms and the Privacy Policy constitute the entire agreement between you and Khula Information Systems cc. regarding the Platform, superseding all prior agreements on the same subject.
